1: Scope of Application

1.1 These general conditions of sale apply to all transactions concluded through the websites of the ACE Strategies network. A "client" is considered as any natural or legal person making an order with the company ACE Strategies via our secure payment platform, or by check or cash.

Article 1a: Age Limit

1.2 Age restrictions apply: ACE Strategies only accepts clients over 16 years old (for physical and electronic products) and over 18 years old (for services: coaching, workshops, seminars). We do our best to restrict access to our sites, products, and services to minors. Any subscriber or customer who does not meet these criteria (age over 16) will be immediately deleted from our database as soon as this is brought to our attention. Likewise, any customer who does not meet these criteria will be immediately reimbursed and a return of the product(s) concerned will be required.

Article 2: Order

2.1 Any order placed on a site belonging to the company ACE Strategies implies full and unreserved acceptance of these general conditions of sale.

Article 3: Price

3.1 The prices are indicated in U.S. dollars. The price of items can be changed at any time. However, the price applied to an order will be that shown at the time of the order.

Article 4: Payment

4.1 Payment is due immediately on the date of the order, including for pre-order products. You can pay by credit card. Cards issued by banks domiciled outside of the U.S. must be international bank cards (American Express, Mastercard, or Visa). Secure online payment by credit card is made through the company Stripe. The information transmitted is encrypted by software in the rules of the art and cannot be read during transport over the network. Any guarantee as to the security of this system is entirely the responsibility of the company Stripe and cannot be attributed to us.

Article 5: Delivery

5.1 Delivery is made to the email or physical address you specified when placing your order (therefore, pay particular attention to the spelling of the address you enter and especially the postal code). The risks will be your responsibility from the date on which the ordered products have left our premises or were emailed to the address on file. However, in the event of a lost package, we will do everything necessary so that you still receive your product or that you are reimbursed according to your warranty.

Article 6: Protection of Personal Data

6.1 In accordance with U.S. data protection laws and regulations, you have the right to access and rectify personal data concerning you. By adhering to these general conditions of sale, you acknowledge having read our personal data protection policy and consent to our collection and use of this data. By entering your email address on one of our network sites, you will receive emails containing information and/or promotional offers concerning products published by ACE Strategies or by other partners. You can unsubscribe at any time. You just have to click on the link at the end of our emails. This link is preceded by the words “To unsubscribe or change subscriber options visit:” (understand: to unsubscribe or change your registration options, click below). Our newsletter is declared to the CNIL under the number NUMEROCNIL and respects the Data Protection Act.

These terms and conditions ("Terms") govern the sale and use of digital products ("Products") offered by ACE Strategies ("ACE Strategies") through its website or any other digital platform ("Platform"). By purchasing or using any Products from ACE Strategies, you agree to be bound by these Terms. If you do not agree to these Terms, please refrain from purchasing or using the Products.

Article 7: Product Description and Use:

7.1 ACE Strategies provides digital Products including but not limited to software, ebooks, templates, audio files, video files, and other digital content. 7.2 The Products are for personal, non-commercial use only. Any commercial use requires prior written consent from ACE Strategies.

7.3 You may not modify, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, Products, or services obtained from ACE Strategies without prior written consent.

Article 8: Ordering and Payment

8.1 By placing an order through the Platform, you agree to pay the specified price for the Products.

8.2 Prices are subject to change without notice. The price charged will be the price displayed on the Platform at the time of purchase.

8.3 Payment must be made in full before access to the Products is provided.

8.4 All payments are processed securely. ACE Strategies does not store any credit card information provided during the payment process.

Article 9: Delivery and Access

9.1 Upon successful payment, you will receive access to download or use the purchased Products.

9.2 Access to the Products may be provided through a download link, email, or any other method deemed suitable by ACE Strategies.

9.3 ACE Strategies will make reasonable efforts to ensure uninterrupted access to the Products. However, we do not guarantee uninterrupted availability.

Article 10: Refunds and Cancellations

10.1 Refunds will be provided solely at the discretion of ACE Strategies.

10.2 To request a refund, you must contact customer support within 1 day of purchase, providing a valid reason for the refund request.

10.3 Refunds will not be provided for Products that have been accessed or downloaded unless there is a proven defect that prevents the proper use of the Product.

Article 11: Intellectual Property

11.1 All intellectual property rights in the Products, including but not limited to copyrights, trademarks, and patents, belong to ACE Strategies or its licensors.

11.2 By purchasing or using the Products, you do not acquire any ownership rights in the intellectual property associated with the Products.

Article 12: Disclaimer of Warranties

12.1 The Products are provided on an "as-is" and "as-available" basis without any warranties, express or implied.

12.2 ACE Strategies disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

12.3 ACE Strategies does not warrant that the Products will meet your requirements or that the operation of the Products will be uninterrupted or error-free.

Article 13: Limitation of Liability

13.1 In no event shall ACE Strategies be liable for any indirect, incidental, special, or consequential damages arising out of or in any way connected with the use or inability to use the Products.

13.2 The total liability of ACE Strategies for any claim arising out of or relating to these Terms or the use of the Products shall not exceed the amount paid by you for the Products.

Article 14: Indemnification

14.1 You agree to indemnify and hold harmless ACE Strategies, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, or expenses arising out of your breach of these Terms or your use of the Products.

Article 15: Governing Law and Jurisdiction:

15.1 These Terms shall be governed by and construed in accordance with the laws of the State of Michigan.

15.2 Any dispute arising out of or relating to these Terms or the use of the Products shall be subject to the exclusive jurisdiction of the courts of Michigan.

Article 16: Changes to Terms

16.1 ACE Strategies reserves the right to modify or update these Terms at any time without prior notice. 16.2 Changes to these Terms will be effective immediately upon posting on the Platform
